Terms of Service

Use of PRE TV's services constitutes agreement to these terms. You can view our privacy policy here.

ACCOUNT SETUP / EMAIL

We will set up your account after payment has been received and we and/or our payment partner(s) have reviewed the order(s) for fraud. It is your responsibility to provide us with an email address that is not @ the domain(s) under which you are registering. In the event of an abuse issue or if we need to contact you, the primary registered email address will be used for this purpose. It is your responsibility to ensure that the registered email address is current or current at all times. If you have a domain name registered with PRE TV, it is your responsibility to ensure that the contact information for your domain account and your actual domain name(s) is correct and up-to-date. PRE TV is not responsible for a lapsed registration due to outdated contact information associated with the domain. If you need to verify or change this information, you must contact us by email. Providing false contact information of any kind may result in termination of your account. In dedicated server purchases or high-risk transactions, it will be necessary to provide government-issued ID and possibly a scan of the credit card used for the purchase. If you do not meet these conditions, the order may be considered fraudulent and be refused.

TRANSFERS

Our support team will do everything they can to help you move your site to us. However, transfers are provided as a courtesy service and we cannot guarantee the availability, possibility or time required to complete an account transfer. Every hosting company is set up differently, and some hosting platforms save data in an incompatible or proprietary format, which can make it extremely difficult, if not impossible, to migrate some or all account data. We will do our best, but in very rare cases we may not be able to assist you with a data transfer from an old host.

Free transfer services are available for 30 days from your signup date and only available if your previous hosting company uses cPanel. If your previous company operated a non-standard control panel, there may be a migration fee.

CONTENT

All services provided by PRE TV may only be used for lawful purposes. The laws of the United Kingdom, Germany, and the European Union apply. The transmission, storage, or presentation of any information, data, or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless PRE TV from any claims resulting from the use of service which damages the subscriber or any other party.

Examples of unacceptable content or links:

  • Pirated software
  • Hacker programs or archives
  • Warez sites
  • MP3s
  • IRC bots

PRE TV will be the sole arbiter as to what constitutes a violation of this provision.

RESOURCE USAGE

User may not:

  • Use 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems, including but not limited to: CGI scripts, FTP, PHP, HTTP, etc.
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
  • Participate in any file-sharing/peer-to-peer activities
  • Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.
  • Run cron entries with intervals of less than 15 minutes.

PRE TV reserves the right to suspend any account that is using excessive resources that is affecting server performance without prior notice.

PAYMENT INFORMATION

All accounts are set up on a prepay basis. Setup fees are charged for all new accounts as well as major account changes and are non-refundable. All pricing is guaranteed for the term of prepayment. PRE TV reserves the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within a week (7 days) of e-mail notice or exceeding this time frame in any way is subject to suspension. The customer is responsible for all money owed on the account from the time it was established until payment is received to terminate service.

CANCELLATIONS AND REFUNDS

PRE TV offers a 24-hour money-back guarantee for new accounts. If you are not completely satisfied with our services within the first 24 hours of your service, you will be given a full refund of the contract amount. This excludes setup fees, domain registration fees, and add-on services. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, canceled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

All cancellations must be done via WhatsApp or email. Phone requests will not be accepted. Cancellations for shared and reseller accounts will be effective on receipt of this notice. Once we receive your cancellation and have confirmed all necessary information with you via email, all files will be removed as a normal course of business.

UPTIME GUARANTEE

PRE TV strives to maintain 99.9% service uptime. This uptime guarantee does not include scheduled maintenance we may perform from time to time. If we fail to meet our uptime guarantee, you may request a credit prorated based on the amount of downtime experienced. All credit requests must be made within 7 days of the downtime.

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold PRE TV harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against PRE TV, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless PRE TV against liabilities arising out of:

  • Any injury to person or property caused by any products sold or otherwise distributed in connection with PRE TV's services.
  • Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
  • Copyright infringement.
  • Any defective products sold to customers from PRE TV's services.

DISCLAIMER

PRE TV shall not be responsible for any damages your business may suffer. PRE TV makes no warranties of any kind, expressed or implied for services we provide. PRE TV disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by PRE TV and its employees.

CHANGES TO THE TOS

PRE TV reserves the right to revise its policies at any time without notice.
